According to the guidelines on the website of the guarantor on privacy (faq guarantor of privacy), for cookies collected by us it is not necessary to obtain prior consent.
By way of example, as clarified by the "Article 29" Group in a recent opinion (WP194), they are cookies for which it is not necessary to obtain the prior and informed consent of the user:
- cookies implanted in the user / contractor's terminal directly by the owner of the single website, if they are not used for further purposes: this is the case of session cookies used to "fill the cart" in online purchases, of authentication ones, cookies for multimedia content such as flash player if they do not exceed the duration of the session, personalization cookies (for example, for the choice of the navigation language), etc.;
- cookies used to statistically analyze site accesses / visits (so-called "analytics" cookies) if they exclusively pursue statistical purposes and collect information in aggregate form; however, the information provided by the website must be clear and adequate and users are offered simple means to oppose (opt-out) their system (including any mechanisms of anonymisation of the cookies themselves).
Excluding technical cookies, also in the new legislation the general rule for "The storage of information in the terminal device of a contractor or a user or access to information already stored" remains that of prior and informed consent of the user ( opt-in). This means that all cookies that do not qualify as "technical" that present greater criticality from the point of view of protecting the privacy of users, such as those used for profiling and marketing purposes can not be installed on users' terminals themselves if they have not been adequately informed before and have not given valid consent in this regard.
